What Happens If You’re Injured During a Break or Lunch in Missouri?

Workplace injuries don’t always happen in the middle of performing job duties. Sometimes, they occur during seemingly “off-the-clock” moments—like lunch or a short break. But does Missouri workers’ compensation law still apply in those situations? Injuries During Scheduled Breaks


Under Missouri law, employees may still be eligible for workers’ compensation if they are injured during a scheduled break—but only if the injury is somehow related to the employment. For example, if you're in the break room at work and suffer a burn from a faulty microwave provided by your employer, that injury could be covered. The same might apply if you slip and fall in the company’s lounge or hallway while on break.

However, injuries that happen while you're offsite and engaging in purely personal activities—such as running errands or going to a restaurant unconnected to your job—are typically not covered.

Lunchtime injuries follow a similar standard. If you were off-premises and not performing any work-related duties, a claim is unlikely to be approved.
